TERMS AND CONDITIONS OF SALE

These terms and conditions apply when you place an order with us via our website. By placing your order, you agree to be bound by these terms and conditions. Therefore, please make sure you have read and understood them before ordering.

1.    Our Products

Each pro​duct purchased conforms to its description. We will t​ake all necessary care​ to ensure that the details, descriptions and prices of the products displayed on our website are accurate.

The images of the products displayed on our website are for illustrative purposes only. Your product and its packaging may differ slightly from the advertising photos displayed on our website, particularly due to your device and its color display. 

The main characteristics of the products are presented on our website. You must familiarise themselves with them before placing an order. The choice and purchase of a product is the sole responsibility of you. The photographs and information presented on our website are not contractual and we may not be held liable in any way whatsoever. In the event of a discrepancy between these photographs and information, on the one hand, and the product(s) chosen by you, on the other hand, we may not be held liable. We reserve the right to modify the composition of the products according to the hazards linked to the supply of raw materials and/or by virtue of the precautionary principle. Product offers are subject to stock availability, as specified when the order is placed.

2.    Prices and Payment Term

The prices on our website are displayed inclusive of VAT in euros unless otherwise stated. The price do not include the delivery charge. In the checkout view, the total cost for your purchase including the delivery charge will be displayed.

We accept all payment methods listed on our website.

Full payment is due at the time of order, and you will be charged when you press the "Pay Now" button at the end of the ordering process.

KOIKE-YA reserves the right to modify prices, discounts and promotions on our website without prior notice. The price charged for any product will be the price advertised at the time of order placement, subject to any applicable promotions or discounts. The final price will be clearly indicated in your order confirmation email.

3.    Discount Codes

You may only use one discount code per order. We reserve the right to reject or cancel any order where you attempt to add more than one discount code to the cart. You are permitted to use discount codes strictly in accordance with the terms of issue, which may include, among other things, conditions relating to your eligibility to use them and the maximum order value.

4.    Your Order

Ordering Process:

Before proceeding with payment, you will have the opportunity to review the contents of your order and the delivery country. You can make changes before proceeding to payment.

You will receive a confirmation email detailing the products you have ordered. This email does not constitute acceptance of your order. Acceptance will occur when the ordered products are shipped.

We will assign a number to your order. This number will be useful whenever you contact us about your order.

The order process will be conducted in English.

Order Rejection:

If we are unable to fulfill your order, we will inform you in writing (including e-mail) and will not charge you for the product. If we have already debited the order amount before rejecting your order, we will refund you. Please note that a few amounts of time may be required to transfer the funds.

Order rejection may result from:

(a) The desired product is out of stock;

(b) Your payment was not authorised;

(c) Due to unexpected limits on our resources that we could not anticipate;

(d) An error in the price or description of the product.

We will not be held responsible for a product that we cannot sell or deliver to you due to these restrictions.

Order Modification:

If the ordered products have already left our warehouses for delivery, we will not be able to add or remove a product from your order. If you wish to add other products, you will need to place a new order.

5.    Delivery

It is your responsibility to provide us with complete and accurate delivery information. We will not be responsible for any inaccuracies or incomplete information provided.

The cost of delivery will be displayed on our website before you finalise your order. Please carefully check these fees; you agree to pay these fees when you confirm your order.

Any items purchased from our website will be shipped by a third party carrier. As a result, title and risk of loss for such items will pass to you upon our delivery to the carrier.

We will not be held responsible for any loss, damage or delay in the delivery of your items.

Any delay in delivery or partial or split delivery does not in any way entitle you to cancel the order outright, to refuse the goods, or to claim any compensation whatsoever.

We may not be held responsible for the partial or total non-performance of its obligations if this non-performance results from a case of force majeure or, more generally, from an event external to the parties, irresistible or reasonably unforeseeable.

6.    Right of Cancellation and Refund

Cancellati​on:

You may cancel your order within 14 days following the receipt by you (in the case of an order involving multiple parcels, from the receipt of the last parcel corresponding to that order).

To exercise the right of cancellation, you must inform us at customer_service@koike-ya.com by an unambiguous statement indicating that you wish to cancel the order.

Refund:

If you wish to report a product as damaged or defective, please first contact our customer service by writing to customer_service@koike-ya.com

We will refund you (in the same manner as the initial payment) within 14 days following the receipt of the returned products. The refund will be made in the currency used at the time of the order. We will refund the products, but not the delivery costs and the return costs.

7.    Personal Information

The personal information collected in the context of our website is compulsory, as this information is necessary for the processing and delivery of orders and for the preparation of invoices. This information is strictly confidential. Failure to provide this information will result in automatic rejection of the order. We undertake not to divulge to third parties the information provided by its customers. This information will only be used for internal management purposes, i.e. to manage orders, invoicing, service, solvency, marketing, or personalized advertising, without this list being exhaustive. It may, however, be communicated to organisations contractually linked with us for their own commercial canvassing.

We undertake to comply with the principles of the Belgian law of 8 December 1992 on the protection of privacy with regard to the processing of personal data. In accordance with the General Data Protection Regulation (GDPR) which came into force on 5 September 2018, you have the right to access, rectify, object to, delete, and port all their personal data at any time by writing, by post and providing proof of their identity, to: customer_service@koike-ya.com

You choose a user name and password when placing the first order in our website. The user name and password serve as proof of your identity and bind you to any order placed by you. You are solely responsible for their user name and password and shall bear the consequences of any use made of them by third parties unless they can demonstrate that knowledge of this user name and password is the result of a fault on the part of us. If you forget their password or identifier, there is a function on the website enabling them to retrieve their identifier and choose a new password.

8.    Intellectual Property

All texts, comments, illustrations, and images reproduced on us via our website are reserved under copyright and intellectual property law. Any total or partial reproduction without our consent is strictly prohibited. The order does not imply any transfer or concession of intellectual rights unless expressly stated.

9.    Resale Prohibition

You undertake not to resell the products from our website.

10. Disputes and Applicable Law

These terms and all the transactions referred to herein are subject to Belgian law. Any complaint must be registered in advance by our customer service at customer_service@koike-ya.com. You shall first contact us to obtain an amicable solution.

If the dispute persists, it will be settled under Belgian law, by the courts of the district of Brussels, which will, in principle, have sole jurisdiction, unless there is an imperative legal provision to the contrary.

Where the interpretation of these conditions differs from the multilingual version, only the English version is valid.
